 A review of the  Blaklader Workwear Kilt  has recently been undertaken by the world famous  Mark Anthony  a renowned journalist.  
   
 It would appear that the intrepid Mark Anthony who incidentally writes for the respected  Demolition News  a periodical focused solely on the world of Demolition visited the now famous   Glastonbury  Festival and wore a Blaklader Kilt during the festival.  
   
 Mark was apparently heard to comment that "the Kilt was awesome and that he didnt care if he wore a skirt at least he knew where his mobile phone was." Presumably this was down to the number of handy pockets on the kilt which was designed by a Swedish student for  Skanska  in Sweden as a garment to be suitable for the extreme temperature variations whilst road bulding in Sweden. 
   
   
   
 The Blaklader Kilt has built up an impressive number of followers.

 History Of Projob Workwear  
 Johan Andersson was a Swede who ventured forth to America in the twenties to seek his fortune. Accompanying him were his wife Saga and the couple’s newly-born daughter Astrid. Johan was strong and enterprising. It didn’t take long before he was given an apprentice carpenter’s position in St. Paul, Minnesota. After a couple of years as apprentice Johan was given permanent employment in one of St. Paul’s largest construction companies. The jobs were many and exciting; two of the ones that Johan worked on were the building of a new zoo and a large city pavilion. Astrid grew up and moved away to study at university and Saga was often alone both day and night.  
   
 After almost twenty years as a carpenter Johan’s body said had had enough. Saga saw how he ached when he came home late at night, how he grimaced when he took all the heavy tools out of his pockets and from his belt. She had longed for something to occupy herself with and decided to help him. The next days Saga spent studying where and how the things Johan carried with him put strain on his body. She also thought about where he kept different things and how the placement of pockets and belt forced him to bend unnaturally.  
   
 Finally Saga took the designs to a friend who owned a sewing machine. She started to remodel a pair of Johan’s worn-out work trousers, since they didn’t have the money to buy new fabric. First she reinforced the areas of the garment that had naturally been exposed to extra wear. Then she moved pockets so that Johan wouldn’t have to bend unnecessarily, lengthened the front and back to increase freedom of movement and padded the knees so that Johan could work on them without pain. When Johan came home and saw the finished trousers he at first wouldn’t hear of wearing different clothes to what everyone else wore. He didn’t want to stand out and if everyone else could stand a little pain in the back and knees he figured he could too. Saga became angry and wanted him to at least try the new trousers. The next day he put them on and went to work. That very evening the back problems began to disappear and a couple of weeks later Johan had forgotten that he had ever been in pain.  
 
      
 Johan’s workmates grew curious about the functional trousers and asked if Saga couldn’t sew more pairs. Soon Saga was sewing carpenter’s trousers from dawn to dusk. Johan and Saga also hit upon new products to develop together. Among other things they devised solutions using pockets and belts solutions that today have developed into entire carrying systems. After over thirty years in America, Johan and Saga decided to return to Sweden. They took the boat home, bringing along patterns, fabrics and new ideas. In the Sweden of the fi fties the new working clothes were received with joy and relief. Both Johan and Saga could work full-time on making new designs and sewing. It was time to think of a name for the company, a name that told who the clothes were for and recalled the time in America. ProJob Workwear was born.

  As an employer you must provide a safe and healthy environment for your employees, including people with disabilities. As well as being safe, you must also take into account their welfare needs. This is a general list of points and does not include any information regarding work place workwear or any   PPE  such as safety boots etc.   
        
   Certain industries such as mining or working with hazardous materials, for example, are covered by separate health and safety legislation but most of the advice below is applicable to most companies and covers basic health and safety requirements.     
       
   
 Adequate Ventilation   
  
     
   There must be good ventilation, a supply of fresh, clean air drawn from outside is required. It must be uncontaminated and circulated around the workspace.      
         
   
 Temperature   
    
    
  
     
   In indoor workplaces, you must provide:      
       
   A reasonable working temperature, usually at least 16C, or 13C for strenuous work, (unless other laws require lower temperatures)      
       
   Local heating or cooling where a comfortable temperature cannot be maintained which is safe and does not give off dangerous or offensive fumes      
       
   Thermal clothing and rest facilities where necessary (for example, for 'hot work' or work in cold storage areas      
       
   
 Lighting   
    
  
     
  You must provide:   
     
   Good light. Try to use natural light where possible but ensure you avoid glare      
   A good level of local lighting at workstations where necessary    
         
   Suitable forms of lighting. Some fluorescent tubes flicker and can be dangerous near rotating machinery    
         
   Special fittings for flammable or explosive atmospheres, e.g. from paint spraying      
         
   
 Cleanliness and Waste Materials 
       
  You must:   
     
   Provide clean premises, furniture and fittings    
         
   Provide clean floors and stairs which are not slippery      
       
   Provide containers for waste materials      
       
   Remove dirt, trade waste and refuse regularly

 Room Space  
       
   Work rooms should have enough space to move about freely.      
       
   
 Work Stations and Seating    
      
      
  
      
   They must be suitable and fit the worker and the worker should be able to leave the work station quickly and easily in the event of an emergency. Make sure that:      
       
   Back rests support the small of the back and you must provide foot rests if necessary      
       
   Work surfaces are at a sensible height      
     
  There is easy access to controls on equipment   
       
   
 Maintenance of the Workplace and Equipment 
     
  Y  ou must have:   
     
  Buildings in good repair   
       
   Safe glazing, if necessary (e.g. painted, toughened or thick) which is marked to make it easy to see      
       
   Good drainage in wet processes      
       
   Weather protection for outdoor work spaces, if practical      
       
   Outdoor routes kept safe in icy conditions, e.g. salted, sanded or swept      
     
  There are other considerations as well eg the safe sitting of machinery and furniture.  
           
   
 Floors and Traffic Routes   
    
    
  
     
  You must have:   
     
   Floors, corridors and stairs kept free of obstructions, e.g. trailing cables      
   Surfaces which are not slippery    
         
   Well-lit outside areas (which will also aid security)      
       
   Safe passages for pedestrians and vehicles      
       
   Level, even surfaces without holes or broken boards      
       
   Hand-rails on stairs and ramps where necessary      
       
   Safe doors, e.g. vision panels in swing doors and sensitive edges on power doors      
       
   
 Falls and Falling Objects    
      
      
  
      
  You must have precautions in place where people might fall from open edges, for example fencing or guard rails.   
     
  You must also have floor openings fenced or covered when not in use, for example vehicle inspection pits.   
     
   Transparent and Translucent Doors, Gates or Walls and Windows     
     
  They must be made of safety material or protected against breakage. If there is a danger of people coming into direct contact with them, there should be markings or features to make them apparent.   
       
   
 Windows   
    
    
  
     
   You must have windows that can be opened and cleaned safely. They should be designed to stop people falling out or bumping into them when open.    
       
   You may also need to fit anchor points if window cleaners have to use harnesses.      
       
   
 Other Doors and Gates 
       
   Should be suitably constructed and fitted with safety devices if necessary.      
       
   
 Escalators and Moving Walkways 
       
   Should function safely and be fitted with safety devices if necessary including one or more emergency stop buttons which are easily identifiable and accessible.      
       
   
 The Provision of Toilets and Washing Facilities 
       
   You must provide:    
         
   Clean well-ventilated toilets (separate rooms for men and women preferably, unless each convenience has its own lockable door      
       
   Wash basins with hot and cold (or warm) running water      
       
   Showers for dirty work or emergencies      
       
   Soap and towels (or a hand drier)    
         
   Special hygiene precautions where necessary, e.g. where food is handled or prepared    
         
   
 Drinking Water 
  
    
  
 You must provide a clean drinking water supply with an upward drinking jet or cups.      
       
   
 Accommodation for Clothing and Changing Facilities 
         
   You must provide lockers and hanging space for clothing and changing facilities where special clothing is worn.    
       
   The facilities should also allow for drying clothes.      
       
   
 Facilities for Rest and to Eat Meals   
    
  
     
  You must supply rest facilities including the facilities for eating food which would otherwise become contaminated.   
     
  Suitable rest facilities should be provided for pregnant women and nursing mothers.   
       
   These are all areas of general workplace safety that all companies must address. However, each company must ensure that their own individual health and safety procedures meet with the minimum legislation standards required of their specific place of employment.

 Kilt That Covers Up Builder's Bum

         BUILDER'S bum   could become a thing of the past in Scotland - thanks to a denim kilt made in Sweden.  The heavy-duty " craftsman's kilt " has become a big hit with Scandinavian workers.  It features two reinforced nail pockets, a loop for carrying a hammer and a knife-holder. And makers Blaklader Workwear describe the 100 per cent cotton kilt as "the ultimate Scottish symbol of masculinity".  Now they have begun exporting the garment - which prevents an unsightly rear view when the tradesman bends over - to the   UK  .  Jeff Adams, boss of Blaklader Workwear in the   UK  , said: "We asked design college students in Gothenburg to create a functional working garment based on a traditional design.   
  Student Marcus Jahnke came up with a craftsman's kilt. He made a prototype and we initially used it for marketing purposes.  "We used it on the front of our catalogue and people saw the    kilt    and it caught on from there. "It has been a pleasant surprise to see it take off. It is now one of our most popular products."  The company have sold more than 5000 to tradesmen in   Sweden   and across  Europe .  They have also created a high visibility version of the kilt for road workers, in bright yellow with reflective stripes.  And the kilt was named product of the year by the Swedish Textile and Clothing Association. Mr Adams added: "There are certain similarities in the nature of the people in   Sweden   and the   UK  .  "Once we knew how successful the kilt was in   Sweden  , we thought it would also catch on in the   UK  .  "Plumbers, electricians and joiners who want to stand out from the crowd are snapping them up. Susanne Kristianson, of Blaklader, based in western   Sweden  , said: "We launched the kilt as a sort of experiment. "We thought only a small number of daring men would wear it. But it proved to be surprisingly popular."  
     
  The kilt even received a mention in the highly respected  Times  newspaper!!!

 PPE Guidelines 
     
  Protective equipment (PPE) at work and this document, explains what you need to do to meet the requirements of the Personal Protective Equipment at Work Regulations 1992 (as amended).   
     
   
 What is PPE? 
  
  
  
  
   
  
   
 PPE is defined in the Regulations as ‘all equipment (including clothing affording protection against the weather) which is intended to be worn or held by a person at work and which protects him against one or more risks to his health or safety’, eg safety helmets, gloves, eye protection, high-visibility clothing, safety footwear and safety harnesses.   
     
  Hearing protection and respiratory protective equipment provided for most work situations are not covered by these Regulations because other regulations apply to them. However, these items need to be compatible with any other PPE provided.   
     
  Cycle helmets or crash helmets worn by employees on the roads are not covered by the Regulations. Motorcycle helmets are legally required for motorcyclists under road traffic legislation.   
    
 What do the Regulations require? 
       
  The main requirement of the PPE at Work Regulations 1992 is that personal protective equipment is to be supplied and used at work wherever there are risks to health and safety that cannot be adequately controlled in other ways.   
     
   
 The Regulations also require that PPE: 
     
  is properly assessed before use to ensure it is suitable;   
  is maintained and stored properly;  
  is provided with instructions on how to use it safely; and  
  is used correctly by employees.  
     
   
 Can I charge for providing PPE? 
     
  An employer cannot ask for money from an employee for PPE, whether it is returnable or not. This includes agency workers if they are legally regarded as your employees. If employment has been terminated and the employee keeps the PPE without the employer’s permission, then, as long as it has been made clear in thecontract of employment, the employer may be able to deduct the cost of the replacement from any wages owed.  
    
 Assessing suitable PPE 
  
   
  
   
 To allow the right type of PPE to be chosen, carefully consider the different hazards in the workplace. This will enable you to assess which types of PPE are suitable to protect against the hazard and for the job to be done.   Ask your supplier for advice on the different types of PPE available and how suitable they are for different tasks. It may be necessary in a few particularly difficult cases to obtain advice from specialist sources and from the PPE manufacturer. Another useful source of information is the British Safety Industry Federation (   www.bsif.co.uk   ).   
  Consider the following when assessing whether PPE is suitable:  
     
  Is it appropriate for the risks involved and the conditions at the place where exposure to the risk may occur? For example, eye protection designed for providing protection against agricultural pesticides will not offer adequate face protection for someone using an angle grinder to cut steel or stone.  
     
  Does it prevent or adequately control the risks involved without increasing the overall level of risk?  
     
  Can it be adjusted to fit the wearer correctly?  
     
  Has the state of health of those who will be wearing it been taken into account?  
     
  What are the needs of the job and the demands it places on the wearer? For example, the length of time the PPE needs to be worn, the physical effort required to do the job and the requirements for visibility and communication.  
     
  If more than one item of PPE is being worn, are they compatible? For example, does a particular type of respirator make it difficult to get eye protection to fit properly?  
     
   
 The hazards and types of PPE 
     
   Eyes   
       
  Hazards: chemical or metal splash, dust, projectiles, gas and vapour, radiation.   
  Options: safety spectacles, goggles, faceshields, visors.  
     
   Head    
     
  Hazards: impact from falling or flying objects, risk of head bumping, hair entanglement.   
  Options: a range of helmets and bump caps.  
     
   Breathing    
     
  Hazards: dust, vapour, gas, oxygen-deficient atmospheres.   
  Options: disposable filtering facepiece or respirator, half- or full-face respirators, air-fed helmets, breathing apparatus.  
     
   Protecting the body    
     
  Hazards: temperature extremes, adverse weather, chemical or metal splash, sprayfrom pressure leaks or spray guns, impact or penetration, contaminated dust,excessive wear or entanglement of own clothing.   
  Options: conventional or disposable overalls, boiler suits, specialist protective clothing, eg chain-mail aprons,    high-visibility clothing   .  
     
   Hands and arms   
     
  Hazards: abrasion, temperature extremes, cuts and punctures, impact, chemicals,  electric shock, skin infection, disease or contamination.   
  Options:    gloves   , gauntlets, mitts, wristcuffs, armlets.   
       
   Feet and legs    
  Hazards: wet, electrostatic build-up, slipping, cuts and punctures, falling objects,metal and chemical splash, abrasion.   
     
  Options:    safety boots    and shoes with protective toe caps and penetration-resistant mid-sole, gaiters, leggings, spats.  
     
   Training   
     
  Make sure anyone using PPE is aware of why it is needed, when it is to be used, repaired or replaced and its limitations.   
     
  Train and instruct people how to use it properly and make sure they are doing this.   
     
  Because PPE is the last resort after other methods of protection have been considered, it is important that users wear it all the time they are exposed to the risk. Never allow exemptions for those jobs which take ‘just a few minutes’.   
  Check regularly that PPE is being used and investigate fully any reasons why it is not. Safety signs can be useful reminders to wear PPE.   
       
   Maintenance   
     
  Make sure equipment is:   
     
  well looked after and properly stored when it is not being used, for example in a dry, clean cupboard, or in the case of smaller items, such as eye protection, in a box or case;   kept clean and in good repair - follow the manufacturer’s maintenance schedule (including recommended replacement periods and shelf lives). Simplemaintenance can be carried out by the trained wearer, but more intricate repairs should only be done by specialists. Make sure suitable replacement PPE is always readily available.  
     
   CE marking    
     
  Ensure any PPE you buy is ‘CE’ marked and complies with the requirements of the Personal Protective Equipment Regulations 2002. The CE marking signifies that the PPE satisfies certain basic safety requirements and in some cases will have been tested and certified by an independent body.  
     
   Other regulations   
     
  The PPE at Work Regulations do not apply where the following six sets of regulations require the provision and use of PPE against these hazards. For example, gloves used to prevent dangerous chemicals penetrating the skin would be covered by the Control of Substances Hazardous to Health Regulations 2002 (as amended). The regulations are:   
     
  The Control of Lead at Work Regulations 2002.  
  The Ionising Radiations Regulations 1999.  
  The Control of Asbestos at Work Regulations 2002.  
  The Control of Substances Hazardous to Health Regulations 2002 (as amended).  
  The Noise at Work Regulations 1989.   
  The Construction (Head Protection) Regulations 1989.   
     
  Key points to remember   
     
  Are there ways (other than PPE) in which the risk can be adequately controlled, eg engineering controls? If not, check that:  
     
  PPE is provided; it offers adequate protection for its intended use;  
  those using it are adequately trained in its safe use;  
  it is properly maintained and any defects are reported;

 GLOVE STANDARDS 
     
  To conform to European legislation, all    gloves    supplied as personal protective equipment   must comply with the Personal Protective Equipment Directive [implemented into law by The Personal Protective Equipment (EC Directive) Regulations 1992] and be CE marked.    
  Products such as    gardening gloves   , of “simple design”, protecting from minor risk of injury can be self-certified by the manufacturer or importer.   
     
   Gloves    worn to protect the user from potentially life threatening risks must be independently tested by an approved test house to an appropriate European Standard.    
     
  A summary of the main glove standards is given below:  
     
 
  BS EN 420 General requirements for all gloves (Sizing, product and packaging information and marking, etc.)  
  BS EN 374-2 Resistance to penetration by micro-organisms  
  BS EN 374-3 Resistance to chemical hazards   
  BS EN 381 Chainsaw hazards   
  BS EN 388 Protect against mechanical hazards   
  BS EN 407 Protect against heat and fire   
  BS EN 421 Protect against ionising radiation   
  BS EN 511 Protect against low temperature  
  BS EN 659 Fire fighters’ gloves   
  One of the important benefits of the standards is marking, which reduces the possibility of gloves being used incorrectly.  
     
  Gloves in the “simple design” category (protecting against minor risk) will have packaging marked with the words “For minimal risks only”.    
     
  Other gloves will have more information on the packaging, including:   
  The CE mark – showing it conforms to the appropriate standard, with the approved body identification number   
     
  A pictogram indicating the gloves protective properties.

    Summary         
   BS EN 471       AND    IS EN 411 Class 2 -  Waistcoats     
   The Torso shall have two horizontal bands of retro-reflective material at least 50mm apart, the lower horizontal band at least 50mm away from the garments bottom edge, with bands over each shoulder joining the upper body band front &amp;amp; back  BS EN 471      AND    IS EN 411 Class 3 -  Jackets    
    The Torso is as given for waistcoats, Full length sleeves should have two bands of retro-reflective material matching those on the torso; the upper band between the elbow and the shoulder, the lower band at least 50mm away from the sleeves bottom edge.     
         
    Class    3          
   Yellow garments are suitable for works on all roads and high speed roads (over 50mph) for maximum visibility. Reflective stripes are 50mm wide.     
         
           
    Class 2          
   Yellow garments are suitable for works on county type/urban roads such as class A and B roads where the speed of traffic is less than 50mph. Reflective strips are 50mm wide.     
       
    Duty of care    
               
   Under the Personal Protective Equipment at Work Regulations 1992, employers have a duty of care to provide their employees with protective safety clothing and equipment that is fit for its intended purpose. In other words, it is up to the employer to assess correctly the level of risk to their employees' health and safety during the course of their work and provide them with adequate protection.      
         
   The Health and Safety Executive (   HSE   ) suggest that a high speed road is one with a speed limit in excess of 50    MPH   . Also see    HSE    Guidance for crossing high speed In the case of high visibility clothing for use on and around roads, the garments you supply must conform to BS EN471:1994 High Visibility Warning Clothing – a European Standard introduced in 1994 which sets out exacting specifications for the performance of high visibility garments and accessories (both new and in use). Items are categorised according to the level of conspicuity they provide and are classified into three classes.      
         
   The Standard sets out specific design criteria for each class of garment, with minimum areas of background and retro reflective materials specified in each case. For instance, jackets, waistcoats and tabards must have bands of retro reflective material in one of the following designs       
 
   two horizontal bands around the torso and one band over each shoulder joining the torso band, or;      
   two horizontal bands around the torso.      
   The bands must not be less than 50 mm wide and long sleeves must be encircled by two bands, which are placed at the same height as those on the torso.      
   The materials used in the manufacture of the garments must meet equally strict specifications, in terms of optical performance, abrasion resistance, colour fastness, influence of rainfall and temperature variation (to name but a few). The finished garments must also contain relevant information (labelling) on storage, cleaning and maintenance, size guidelines, results of technical performance tests and the name and address of the manufacturer or their authorised representative.       
    What you need to know?    
               
   If you are supplying your employees with appropriate high visibility safety products for use on or near to roads, ask the following questions of your supplier:        
 
   Do the garments conform to the BS EN471 Standard?      
   Are independent test/certification results available?      
   Do the garments carry the necessary labelling information?      
   Are the garments suitable for decoration - will they still conform to the Standard once they have been printed/badged?      
   What area of material has been allowed for badging – what is the maximum area of background material you can cover without compromising the garments' conspicuity?       
   Introduced in 1994,  BS EN471 High Visibility Warning Clothing  is the current European Standard governing high visibility safety wear. The Standard is split into three classes of garments, based on their level of conspicuity: -   Class 3 (highest level of conspicuity)  Items include:        
 
   coats and jackets with sleeves      
   coveralls      
   two-piece combination suits (if marked correctly)       
    Class 2 (intermediate level conspicuity)    Items include:        
 
   sleeveless waistcoats      
   tabards      
   bib and brace overalls       
     Class 1 (lowest level of conspicuity)  Items include:          
 
   waistband trousers      
   harnesses        
   Materials must maintain specific performance levels and in the case of care, garments must state the maximum appropriate number of care cycles the item is capable of withstanding.        
         
    Retro reflective material    
               
   The optical performance levels of retro reflective material are specified within section 6 of the Standard and Class 2 provides the optimum level of brightness. There are other tests the material has to be subjected to in order to achieve compliance:        
 
   abrasion resistance      
   flexing capabilities      
   influence of rainfall and temperature variation       
    Background material    
               
   Section 5 covers the requirements for background material. These include:        
 
   colour      
   colour fastness      
   dimensional change      
   mechanical properties      
   ergonomics        
   The recognised colour in the       UK     is fluorescent yellow and, unless an employer's risk assessment suggests otherwise, this is the colour that should be used on all roads.   
           
    Health and safety requirements    
               
   When items of Personal Protection Equipment are placed on the market, they must contain relevant information on:        
 
   storage, use, cleaning and maintenance      
   wear information including sizing guidelines      
   model description       
   Performance as recorded during technical tests to check levels or classes of protection.      
         
   Name and address of the manufacturer and/or their authorised representative

 Each piece of workwear is tested in every way possible before it is released for sale.  
   
   
 
 Recommendations from users and industries 
    
  Users from a wide range of industries are invited by MASCOT to join a discussion.  
   
 Participants are chosen to represent several age groups and job functions.  
   
 By doing so, new requirements and trends among users are identified, and this information is used in the next phase during the conceptualisation of new products.  
    
   
 
 Materials are tested in actual work situations 
  
   
 Test garments are sewn up further on in the development stage.  
   
 As an example, this can be a pair of trousers with one type of fabric used on one leg and another type of fabric used on the other leg.  
   
 The members of our test team use the test garment for a period of time, after which exhaustive interviews are conducted to discuss the users' experience with the fabric and its properties.   
   
 
 Function and fit tested on the job 
  
   
   
 Once the fabric is chosen, function and fit is then tested.  
   
 New products are sewn up and the members of our test team undertake a new round of tests where the garments are used in their everyday work.  
   
 A journal is kept during the test period while the garments are subjected to normal wear and tear, as well as regular wash.  
   
 Hereafter, recommendations for changes and adjustments are reported back to MASCOT who will then interpret the feedbacks from the users. I 
   
 t is only when all adjustments are undertaken that the final design can be put into production.  
   
 This way, MASCOT ensures that products are TESTED TO WORK before they are put out for sale

 1. Workwearthatworks.com is part of Active Workwear ("Active Leeds Ltd"), Active Workwear's Conditions Apply  
  -------------------------------------------------------------------------------- 1.1 Unless otherwise specifically agreed in writing by Active Workwear ("Active Leeds Ltd"), all quotations and contracts for the supply of goods by Active Workwear are made upon these Conditions of Sale ("the Conditions") which shall at all times override any terms and conditions which the purchaser of such goods ("the Purchaser") imposes or seeks to impose. 
 1.2 Delivery of any goods following a quotation for supply made by Active Workwear will be made only upon the Conditions. Orders are accepted subject to the Conditions. 
 1.3 Any variation must be approved by an authorised Active Workwear employee and be in writing. Any quotation or estimate is given subject to the Conditions. 
 1.4 “The Contract” means any contract made between the parties that incorporates the Conditions. 
    
 2. Payment Terms 
  
  
 -------------------------------------------------------------------------------- 2.1 Terms of payment are strictly net monthly (i.e. payment on or before the end of the month following the month during which the invoice is dated) and in default Active Workwear shall be entitled without notice to the Purchaser (even if the Purchaser has a contract with a third party) to: 
 2.1.1 terminate any outstanding order or quotation; 
 2.1.2 withhold and/or suspend supplies; or 
 2.1.3 reduce the Purchaser's credit limit. 
 2.2 Active Workwear shall also be entitled, at their discretion, to receive payment of any and all monies in respect of goods supplied whether these monies would ordinarily be due for payment at that time or not. 
 2.3 In addition, Active Workwear shall be entitled to charge the Purchaser interest on the amount unpaid at the rate of 8% above HSBC Bank Plc base rate until payment in full is made and the Purchaser will indemnify Active Workwear in respect of all costs incurred by Active Workwear in recovering payment, including the cost of instructing Solicitors. 
 2.4 No payment shall be deemed to have been received until Active Workwear has received cleared funds. 
 2.5 In the event that the Purchaser tenders payment by cheque and the cheque is subsequently returned by the Purchaser's Bankers unpaid, the Purchaser will also indemnify Arco in respect of all resulting bank charges incurred by Active Workwear. 
 2.6 The Purchaser shall make all payments due under the Contract without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless the Purchaser has a valid court order requiring an amount equal to such deduction to be paid by Active Workwear to the Purchaser. 
    
 3. Prices  
 -------------------------------------------------------------------------------- 3.1 All prices displayed in Active Workwear's catalogues both printed and online are subject to VAT where applicable. 
 3.2 Prices are correct at time of publishing and are subject to change without prior notice. 
 3.3 The price charged to the Purchaser will be the prevailing price at the time of ordering. 
    
 4. Retention of Title 
  
  
  --------------------------------------------------------------------------------  4.1 Although risk in the goods supplied passes to the Purchaser on delivery, legal title in such goods shall not pass to the Purchaser until Active Workwear has received in cleared funds the full price payable for such goods and all other goods supplied by Active Workwear to the Purchaser for which payment is then due. 
 4.2 Until legal title passes, the Purchaser shall hold the goods as Active Workwear's fiduciary agent and bailee and shall keep them properly protected, insured and stored separately from any other goods (whether or not supplied by Active Workwear). Until that time the Purchaser is entitled to resell or use the goods in the ordinary course of its business but shall account to Active Workwear for the proceeds of sale and pending payment shall hold such proceeds on trust for Active Workwear absolutely. 
 4.3 The Purchaser's right to resell or use the goods shall terminate automatically on the occurrence of any event set out in Condition 10 and/or if any sum owed to Active Workwear by the Purchaser is not paid when due. 
 4.4 Until such time as legal title in the goods passes to the Purchaser Active Workwear may at any time require the Purchaser, its liquidator, receiver or administrator to return the goods and/or may repossess the goods by entering upon any premises of the Purchaser or any third party where the goods are reasonably believed to be stored. 
 4.5 In addition and without prejudice to any other right or remedy available to Active Workwear, if the Purchaser is in breach of the payment terms or of any of its obligations under this clause, Active Workwear shall be entitled to: 
 4.5.1 cancel the Contract; 
 4.5.2 suspend further deliveries; or 
 4.5.3 terminate any outstanding order or quotation without incurring any liability whatsoever as a consequence of this action. 
 4.6 Active Workwear reserves the right at any time before title in the goods has passed to the Purchaser to require the Purchaser to deliver up the goods if any of the events specified in Condition 10 occurs. 
    
 5. Delivery  
 -------------------------------------------------------------------------------- 5.1 Terms and conditions for delivery are only applicable in the UK. For delivery outside the UK please contact our offices for further details. 
 5.2 Unless otherwise agreed delivery of the goods shall take place at the Purchaser’s place of business. 
 5.3 Where Active Workwear makes delivery of the goods to the Purchaser’s place of business or any other place as agreed in writing, all charges in relation to carriage, including, without limitation transport costs, insurance and unloading, will at Active Workwear's option, be borne by the Purchaser. 
 5.4 If for any reason the Purchaser does not accept delivery of any of the goods when they are ready for delivery then the goods will be deemed to have been delivered, risk passing to the Purchaser (including for loss or damage caused by Active Workwear's negligence) and Active Workwear may: 
 5.4.1 store the goods until actual delivery whereupon the Purchaser will be liable for all related costs and expenses (including without limitation storage and insurance); or 
 5.4.2 sell the goods at the best price readily obtainable and (after deduction of all reasonable storage and selling expenses) charge the Purchaser for any shortfall below the Contract price. 
 5.5 Active Workwear reserves the right to deliver in instalments and any failure to deliver one instalment will not entitle the Purchaser to terminate the Contract. 
 5.6 The quantity of any consignment of goods as recorded by Active Workwear upon despatch from Active Workwear's place of business shall be conclusive evidence of the quantity received by the Purchaser on delivery unless the Purchaser can provide conclusive evidence proving the contrary. 5.7 Claims for shortages or damaged goods must be made in writing to Active Workwear within 3 days of receipt. 
 5.8 Claims for non delivery must be made to Active Workwear within 10 days of date of despatch shown on invoice. 
 5.9 Active Workwear reserves the right to charge a 15% handling fee against the return of non-faulty goods. 
 5.10 Postage Calculations are applied according to value of order: 
 5.10.1 Order Value: £0.01 to £9.99 - delivery charge £4.00 
 5.10.2 Order Value: £10.00 to £24.99 - delivery charge £5.00 
 5.10.3 Order Value: £25.00 to £74.99 - delivery charge £6.00  
 5.10.4 Order Value: £75.00 + - delivery charge FREE 
    
 6. Quality  
  -------------------------------------------------------------------------------- 6.1 If the Purchaser establishes to Active Workwear's reasonable satisfaction that there is a defect in the goods or there is some other failure by Active Workwear in relation to the conformity of the goods with the Contract, then Active Workwear shall, at its option and at its sole discretion and within a reasonable time: 
 6.1.1 replace such goods with goods which are in all respects in accordance with the Contract; or 
 6.1.2 issue a credit note to the Purchaser in respect of the whole or part of the Contract price of such goods as appropriate having taken back such goods, subject, in every case, to the remaining provisions of this Condition provided that the liability of Active Workwear under this Condition shall in no event exceed the purchase price of such goods and performance of any one of the above options shall constitute an entire discharge of Active Workwear’s liability under this warranty. 
 6.2 This Condition shall not apply unless the Purchaser: 
 6.2.1 notifies Active Workwear in writing of the alleged defect within 3 days of the time when the Purchaser discovers or ought to have discovered the defect; and 
 6.2.2 affords Active Workwear a reasonable opportunity to inspect the relevant goods. 
 6.3 If Active Workwear elects to replace the goods pursuant to this Condition, Active Workwear shall deliver the replacement goods to the Purchaser at Active Workwear's own expense at the address to which the defective goods were delivered and the legal title to the defective goods which are being replaced shall (if it has vested in the Purchaser) re-vest in Active Workwear and the Purchaser shall make any arrangements as may be necessary to deliver up to Active Workwear the defective goods which are being replaced to Active Workwear. 
 6.4 Active Workwear shall be under no liability under the warranty in this Condition: 
 6.4.1 in respect of any defect arising from wilful damage, negligence, abnormal storage conditions, failure to follow Active Workwears’s or the manufacturers instructions whichever is appropriate (whether oral or in writing). 
 6.4.2 if the total price for the goods has not been paid by the due date for payment; 
 6.4.3 in respect of any type of defect or damage specifically excluded by Active Workwear by notice in writing; or 
 6.4.4 if the Purchaser makes any further use of the goods after giving notice in accordance with this Condition. 
 6.5 The warranties set out in this is document are the only warranties which shall be given by Active Workwear and all warranties, conditions and other terms implied by statute are expressly excluded. 
    
 7. Liability 
 --------------------------------------------------------------------------------  7.1 Subject to Condition 6 above this Condition sets out the entire liability of Active Workwear (including any liability for the acts or omissions of its employees, agents and sub-contractors) to the Purchaser in respect of: 
 7.1.1 any breach of the Conditions or the Contract; and 
 7.1.2 any representation, statement or tortious act or omission including negligence arising under or in connection with the Contract. 
 7.2 Nothing in the Conditions excludes or limits the liability of Active Workwear for death or personal injury caused by Active Workwear’s negligence, or for fraudulent misrepresentation. 
 7.3 Liability for any direct loss or damage which arises out of or in connection with the Contract shall be limited to the contract value. 
 7.4 Active Workwear shall not be liable to the Purchaser for any loss of profit or other economic loss (direct or indirect), indirect or consequential loss or damage, costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) or loss or damage (contractual, tortious, breach of statutory duty or otherwise) which arises out of or in connection with the Contract, or for any liability incurred by the Purchaser to any other person for any economic loss, claim for damages or awards howsoever arising from the goods or otherwise. 
    
 8. Safety and Product Recalls 
  --------------------------------------------------------------------------------  8.1 The Purchaser shall comply at all times with the written instructions and all written guidelines issued from time to time attached to the goods concerning their storage and use and the Purchaser shall refer its employees and its customers to such instructions and guidelines. 
 8.2 The Purchaser should satisfy itself that the persons responsible for the storage and use of any goods supplied by Active Workwear have all the information required on health and safety and Active Workwear shall not be liable to the Purchaser in any civil proceedings brought by the Purchaser against Active Workwear in respect of a breach of the user instructions or any applicable health and safety legislation or any regulations, orders or directions made pursuant to such health and safety legislation in force from time to time or under any directive, regulation, order or other instrument relating to health and safety where such exclusion of liability is permitted by law. 
 8.3 The Purchaser shall keep Active Workwear properly informed of all customer complaints concerning the goods and shall comply with any directions of Active Workwear in any issues, proceedings or negotiations relating to such complaint. 
 8.4 In the event of any recall of the goods by Active Workwear the Purchaser shall co-operate fully and promptly with any steps taken by Active Workwear under the Condition below. 
 8.5 Active Workwear may at its discretion recall any goods already sold by Active Workwear to its customers, (whether for a refund or credit or for replacement of the goods which shall in each case by undertaken by Active Workwear) and/or issue any written or other notification to its customers about the manner of use of any goods already sold by Active Workwear to its customers. The customer agrees to give all reasonable assistance to Active Workwear or the manufacturer in resisting any claim which may arise under any recall of product by Active Workwear or the manufacturer of such product. 
    
 9. Force Majeure 
  
  
  --------------------------------------------------------------------------------  9.1 Active Workwear reserves the right to defer the date of delivery or to cancel the Contract or reduce the volume of the goods ordered by the Purchaser (without liability to the Purchaser) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of Active Workwear including, without limitation, acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood, epidemic, lockouts, strikes or other labour disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials provided that, if the event in question continues for a continuous period in excess of 180 days, the Purchaser shall be entitled to give notice in writing to Active Workwear to terminate the Contract. 
    
 10. Termination 
 --------------------------------------------------------------------------------  10.1 Active Workwear may, as it thinks fit, (without prejudice to any other rights or remedies it may have against the Purchaser) immediately suspend further performance of the Contract or cancel delivery of the goods or stop any goods in transit or by notice in writing to the Purchaser terminate the Contract without liability to Active Workwear if: 
 10.1.1 the Purchaser commits a material breach of any of its obligations under the Contract which is incapable of remedy; 
 10.1.2 the Purchaser fails to remedy a breach of its obligations under the Contract which is capable of remedy, or persists in any breach of any of its obligations under the Contract after having been requested in writing by Active Workwear to remedy or desist from such breach within a period of 14 days; 
 10.1.3 any distress execution or diligence is levied upon any of the Purchaser's goods or property and is not paid out within 7 days of it being levied; 
 10.1.4 the Purchaser (being a partnership) or the Purchaser's partner offers to make any arrangements with or for the benefit of the creditors of the Purchaser or the Purchaser's partner generally or there is presented in relation to the Purchaser or the Purchaser's partner a petition of bankruptcy; 
 10.1.5 the Purchaser (being a limited company) is deemed to be unable to pay its debts within the meaning of Section 123 of the Insolvency Act 1986 or the Purchaser calls a meeting for the purpose of passing a resolution to wind up its company or such a resolution is passed or the Purchaser presents or has presented a petition to wind up or present or have presented a petition or appoint an administrator or have an administrative receiver or receiver appointed to the whole or any part of the Purchaser’s business, undertaking, property or assets; 
 10.1.6 the Purchaser ceases, or threatens to cease, to carry on business; 
 10.1.7 a secured lender to the Purchaser takes any steps to obtain possession of the property on which it has security or otherwise to enforce its security. 
 10.2 Notwithstanding any such termination or suspension in accordance with the above the Purchaser shall pay Active Workwear at the Contract rate all payments subsisting at the time of termination. 
    
 11. Product Information 
  
  
  --------------------------------------------------------------------------------  11.1 Whilst Active Workwear has made every effort to ensure that details and information given in both our printed and online publications are accurate at the time of issue, full technical specifications are not necessarily included and furthermore, Active Workwear's policy is one of continuous improvement and the right is reserved to alter details and information as the need arises. 
 11.2 Accordingly, the Purchaser should check any details and information they wish to rely on with Active Workwear at the time of purchase. Active Workwear cannot accept liability in respect of any errors or omissions herein contained or for any loss or damage, malfunction or consequential loss arising from reliance upon our publications. 
    
 12. Active Workwear Disclaimer  
 -------------------------------------------------------------------------------- 12.1 Any products shown in both our printed or online publications do not represent endorsement by Active Workwear of any other products, services or organisations.

 15. Assignment 
  
  
  --------------------------------------------------------------------------------  15.1 The Purchaser shall not be entitled to assign the Contract or any part of it without the prior written consent of Active Workwear. 
 15.2 Active Workwear may assign the Contract or any part of it to any person, firm or company. 
    
 16. General 
  --------------------------------------------------------------------------------  16.1 Each right or remedy of Active Workwear under the Contract is without prejudice to any other right or remedy of Active Workwear whether under the Contract or not. 
 16.2 Each party agrees to keep secret and confidential all information obtained or disclosed as a result of the relationship of the parties under the Contract. 
 16.3 If any provision of the Contract is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, voidable, unen-forceable or unreasonable it shall to the extent of such illegality, invalidity, voidness, voidability, unenforceability or unreasonableness be deemed severable and the remaining provisions of the Contract and the remainder of such provision shall continue in full force and effect. 
 16.4 Failure or delay by Active Workwear in enforcing or partially enforcing any provision of the Contract will not be construed as a waiver of any of its rights under the Contract. 
 16.5 Any waiver by Active Workwear of any breach of, or any default under, any provision of the Contract by the Purchaser will not be deemed a waiver of any subsequent breach or default and will in no way affect the other terms of the Contract. 
 16.6 The parties to this Contract do not intend that any term of this Contract will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it. 
 16.7 The formation, existence, construction, performance, validity and all aspects of the Contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.

   Well what can I say winter is here and the local council have once again been caught out ....result chaos and all over a little bit of snow!

   Our  Blaklader  ( Blaklader are Sweden's leading workwear brand with cutting edge designs and functionality at competetive prices)  sales still continue to grow as the Blaklader workwear clothing is, even if we do say so ourselves fantastic especially the new additions to the allready good range such as the  1500 XTRM  trousers with a lifetime guarantee on the seams as have the  blaklader work trousers  and  work jackets  that blaklader sell.    
       
   At active workwear our friendly staff headed up by    Marc the shop manager are all happy to discuss any of the range of work wear and industrial safety products that we sell in the workwear clothing emporium at Active Workwear.   
     
   We have recently updated our embroidery and logo printing services for all our customers and are now able to offer embroidery or printing to a lot of the work clothes on sale, from the traditional fruit of the loom polo, gildan basically any garment that we sell can be personalised.   
       
   As usual our sales of quality High Visibility garments from the  B Seen Hi Vis  Bomber to the hi  vis waiscoat/vest  have increased as the dark nights draw in and the need for road safety and visibilty increases.     
     
   The sale of  fleeces  have also gone up especially to the local community support police officers.
